1. Terms of sales and processing of personal data

The owner of the online store skovex.ee (hereinafter referred to as the online store) is Skovex OÜ (reg code 10900408), located at Savi tn 7, 80040 Pärnu, Pärnumaa.

2. Validity of contract of sale, product and price information 

The conditions of sale apply to purchases of goods from the online store.

The prices of the products sold in the online store are indicated next to the products. A fee for shipping is added to the price.

The shipping cost depends on the location of the purchaser and the shipping method. The shipping cost is displayed when the purchaser places the order.

Product information is provided immediately adjacent to the product in the online store.

3. Placing an order 

Add the desired products to your shopping basket to order them.  Fill in all of the required fields and choose the most suitable shipping method to complete the order. The total cost is then displayed on the screen. This can be paid via bank transfer.

The contract enters into force when the amount payable is transferred to the bank account of the online store within one working day.

4. Paying for the goods 

If the Customer has confirmed the order, an advance payment invoice will be immediately sent to the e-mail address entered by the Customer, on the basis of which the goods can be paid for.

The advance payment invoice contains the products ordered by the Customer and the contact details where the order will be sent. The e-invoice also contains the details of Skovex OÜ and the bank account where the payment can be made.

If the Customer has not paid the e-invoice within 1 working day from the date of issue, the Seller considers this as the Customer's wish to cancel the purchase and cancels the order.

5. Shipment

The purchaser bears the shipping cost and the respective price information is displayed next to the shipping method.

In case of a change of destination, the Seller asks the Customer to inform the new data as soon as possible. If the item has already been posted, it is no longer possible to change the destination.

6. Right of withdrawal

The Seller reserves the right to cancel the Customer's order if the Customer has not paid the amount on the advance invoice to the bank account of Skovex OÜ within 1 working day from the issuance of the advance invoice. Before canceling the order, a reminder letter is sent to the Customer's e-mail address.

If the product does not fit or does not meet the Customer's expectations, they have the right to return it within 5 working days after receiving the product. Returned goods must be undamaged, unused, with tags, in the original packaging and properly packed. 80% of the value of the goods will be returned to the customer, based on the price of the discounted product on the invoice.

The money for the returned goods will be returned to the Customer's bank account within 2 working days, but no later than within 7 working days from the receipt of the goods by Skovex OÜ.

If the ordered product arrived at the Customer with a scrap that was not immediately identified on external inspection and that did not occur when the package was opened, or if the product is not what the Customer ordered, please inform us immediately by e-mail info@skovex.ee. Returned goods must be unused, with tags and in the original packaging. The new goods will arrive at the Customer within 3-5 days after the returned goods have been received by the Seller.

If the product to be returned is damaged and this situation is caused by the Customer's inappropriate use of the product, the Customer's fault or negligence, the Seller reserves the right not to exchange the product.

7. Warranty and return of non-conforming products 

According to the Debt Law Act (VÕS, Chapter 11, Section 218, Subsection 2), the Customer has the right to submit a claim within two years from receipt of the goods. In the case of a defect occurring within the first six months, it is assumed that it was present at the time of purchasing the product, and the nature of the defect must be determined by the seller.

If the defect is of a technological nature, the Customer may demand that the product be repaired and, if the repair is impossible or ineffective, that the product be replaced. It is possible to request a refund if the replacement has not been possible within a reasonable time due to the lack of a suitable product (VÕS, Chapter 11, Section 222, Paragraph 1).

In the event of an unexpected defect, the Customer must send an e-mail to info@skovex.ee with the following information: Customer's name and contact details; the date of filing the complaint; a defect that appeared on the product, please also include photos; a claim to be made to the seller; invoice number, if possible include a copy of the invoice.

The corresponding application must be sent no later than 2 months after the defect appeared. In case of non-observance of the said term without good reason, the Customer loses the right to demand free product repair or replacement of the part.

The online store has the right to refuse to make the refund until the goods being returned are received or until the buyer has provided proof of returning the products, whichever occurs first.

8. Other terms

Skovex OÜ uses the personal data provided by the Customer only to fulfill the Customer's purchase order and does not disclose information obtained during purchases to third parties, except To AS Eesti Post, Itella SmartPOST OÜ, DPD Eesti AS, Cargobuss OÜ and in cases prescribed by law.

The Seller reserves the right to send the Customer information about new products and special offers. The customer has the right to request the deletion of his data from the Skovex OÜ database.

In matters not regulated in these conditions, the Client and Skovex OÜ are guided by the legislation in force in the Republic of Estonia and other acts regulating relations between the parties.

Disagreements and disputes arising from the fulfillment of these terms and conditions shall be resolved by the parties primarily through negotiations. If the disputes arising from the Agreement cannot be resolved through negotiations between the parties, both the Customer and the Seller have the right to appeal to the Consumer Protection Board or the court for the protection of their rights.

9. MUUD TINGIMUSED

9.1. Skovex OÜ kasutab Kliendi poolt antud isikuandmeid ainult Kliendi ostutellimuse täitmiseks ning ei avalda ostude käigus teatavaks saanud informatsiooni kolmandatele osapooltele, v.a. AS-ile Eesti Post, Itella SmartPOST OÜ-le, DPD Eesti AS-ile, Cargobuss OÜ-le ja seadusega ettenähtud juhtudel.

9.2. Müüja jätab endale õiguse saata Kliendile infot uute toodete ja sooduspakkumiste kohta. Kliendil on õigus nõuda oma andmete kustutamist Skovex OÜ andmebaasist.

9.3. Käesolevates tingimustes reguleerimata küsimustes juhinduvad Klient ja Skovex OÜ Eesti Vabariigis kehtivast seadusandlusest ning pooltevahelisi suhteid reguleerivatest teistest aktidest.

9.4. Käesolevate tingimuste täitmisest tulenevaid eriarvamusi ja vaidlusi lahendavad pooled eelkõige läbirääkimiste teel. Kui Lepingust tulenevaid vaidlusi ei õnnestu lahendada poolte läbirääkimistega, on nii Kliendil kui Müüjal õigus pöörduda oma õiguste kaitseks Tarbijakaitseametisse või kohtusse.

10. Final provisions

Estonian law applies to these ordering conditions and the purchase and sale agreements of the Seller's e-store. If any provision of the order conditions is invalid, this does not affect the validity of the rest of the order conditions or the purchase and sale agreement. A void provision is replaced by a legal provision that is legally and economically closest to the void provision.
